Agreement to Terms
By accessing our website or engaging ArrowHit for services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our services.
Services
ArrowHit provides web design, development, SEO, and ongoing support services. The specific scope of work for your project will be outlined in a separate proposal or project brief. We reserve the right to modify or discontinue any service at any time.
Payments & Monthly Plans
Our pricing model typically involves a one-off setup fee followed by a monthly plan (Care, Growth or Partner).
- Setup Fee: 50% due before project commencement and 50% on delivery, unless otherwise agreed.
- Monthly Plans: Billed monthly in advance. Every plan covers hosting, domain management (where applicable), security updates and a set monthly allowance of update time; higher tiers add AI upkeep, reporting and SEO as described on the Pricing page. Work beyond your plan's allowance is billed at the current hourly rate, agreed before it starts.
- AI Features: AI add-ons (chatbots, automations and similar) require an active Growth plan or above, which covers their monitoring, tuning and third-party AI usage costs at fair use.
- Late Payments: We reserve the right to suspend services (including website hosting) if payments are more than 14 days overdue.
Intellectual Property
Upon final payment of all outstanding invoices, ownership of the website's custom design and content is transferred to you. ArrowHit retains ownership of any pre-existing code, libraries, or tools used in the development process, but grants you a non-exclusive, perpetual license to use them as part of your website.
Client Obligations
To ensure project success, you agree to:
- Provide all necessary content (text, images, branding) in a timely manner.
- Provide feedback within agreed timeframes.
- Ensure you have the legal right to use any materials provided to us.
Termination & Cancellation
You may cancel your monthly plan at any time, effective at the end of your current billing month. There are no lock-in contracts or cancellation fees. Upon termination:
- We will provide you with a complete copy of your website files (and database, where applicable) at no charge, so you can host your site anywhere.
- Hands-on migration assistance (setting your site up with a new host) is available at the current hourly rate if you'd like the help.
- Access to ArrowHit-operated tools or dashboards will be revoked.
- Ongoing hosting and domain management become your responsibility from the end of the billing period.
Limitation of Liability
ArrowHit will not be liable for any indirect, incidental, or consequential damages resulting from the use of our services, including but not limited to loss of profits, data, or business interruption. Our total liability is limited to the amount paid by you for the specific service in question.
Governing Law
These terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the courts of NSW.
